Starting from September 1 the State Labor Service of Ukraine resumes its inspections

Starting from June 2020 after the easing of the quarantine restrictions, labor inspectors together with the representative of the State Tax Service, Pension Fund of Ukraine, employment centers, local municipal authorities, the National Police started explanatory campaign about the planned inspection measures. Their visits during this period are not inspections.

Large scale inspections will be conducted starting from September 1, 2020. The controllers will initially visit the employers with the highest risk of use of the employees that are not officially employed. First of all, it concerns individual entrepreneurs, whose scope of provided services (performed works) does not correspond to the actual number of employed staff, who decreased the number of employed staff during the quarantine and do not increase the respective number after the mitigation of the quarantine restrictions, as well as entrepreneurs that conceal labor relations substituting them with other type of civil or economic relations. It may be tracked in the monthly reports on SSC.

We remind that the State Labor Service of Ukraine has the right to visit individual entrepreneurs-employers with an inspection at any time without warning. The inspector should only show the official ID and only upon the employer’s request – copy of the inspection order. The inspection may last not more than 10 days. The controller has the right to check any documents regarding the employees, speak with the individual entrepreneur or employees alone or with witnesses. During the visit the inspector is allowed to take photos, videos or record audios, as well as to involve enforcement bodies.

The inspector may not be allowed to conduct inspection, if the inspector refuses to show the official ID. If the official ID is provided but the individual entrepreneur has doubts regarding its authenticity, inspector’s ID and picture may be checked in the register on the website of the State Labor Service of Ukraine
