How to get partial unemployment benefits for employees

In connection with quarantine, many entrepreneurs are forced to reduce their activities. Therefore, their employees lost all or part of their wages. To somehow compensate for these losses, on April 22, the government adopted Decree No. 306 on assistance for partial unemployment during the quarantine period for SMEs.

ELFs who have stopped (reduced activity) due to quarantine and during the last 6 months preceding the suspension (reduction) of activity have the right to receive assistance paid ERUs for wage earners with whom the employment relationship has not ceased at the date of application to the employment center (TS) ) Employees receiving a pension, or working part-time, or receiving payment for downtime are not eligible for benefits.

Assistance is established for every hour of lost working time at the rate of 2/3 of the salary and cannot exceed the size of the minimum wage (4723 UAH). Assistance is provided for the period of suspension (reduction) of activity and within 30 calendar days after the end of the quarantine.

To receive such assistance, the FLP-employer applies to the registration center in which he is registered with a package of documents, the list of which is determined by Order No. 306, within 30 calendar days from the date of suspension (reduction) of activity. Having examined the documents, the oblast or Kiev city center is required to make a decision on the provision or denial of assistance within 3 working days. Such a decision is drawn up by order. If a positive decision is made within 3 days, the CZ with the FLP enter into an agreement of the established form.

On a monthly basis, the FLP must provide to the central office information about persons entitled to receive such assistance. After receipt of funds to your account, the TSZ transfers them to the employer within 3 business days, which must also be paid on a separate statement by no more than 3 business days after receipt.

 It should be noted that the FLP will have to return the funds if it releases the worker to whom the allowance was paid, within six months (if the aid was paid less than 180 calendar days - for a period equal to the period of payment of the allowance) at will or by agreement of the parties, or case of staff reduction.
