Restore work after quarantine

The government eased quarantine, and entrepreneurs began to gradually restore their work. Depending on the type of activity, the owners take part of their employees or the entire staff to work places. This process should be properly documented, since the restoration of work does not occur on its own.

The resumption of work was made possible because the KMU decree dated 04.05.2020 No. 343 eased quarantine restrictions. When restoring their activities, FLPs should pay attention to two points: the procedure for opening their facility and the design of the start of work for employees. Since work began before the official end of quarantine, you need to draw up the relevant documents.

Open the object

To open an object, you need to issue an order, because by closing it in quarantine, the FLP had to issue an order. All employees must be familiarized with the order to resume work under signature. If the FLP decides to temporarily change the mode of operation, it is necessary to register it at the disposal, and on the facade of the object to place an announcement about the new mode of operation (if it is temporarily changed).

In addition to the order to open the facility, the FLP should develop a Regulation on work during quarantine. This document reflects the features of customer service (customers) and the processing order of the premises in accordance with established standards. To develop the Regulation, we recommend using the recommendations of the Chief State Sanitary Doctor of Ukraine, set out in the relevant resolutions of 05/09/2020, for your type of activity. The provision must be approved by order and familiarized with it under the signature of workers.

Many of the entrepreneurs issued so-called “quarantine” vacations to their employees without pay. More often than not, an employee asked for such leave before quarantine is completed. And some FLP were forced to issue a simple one. Depending on how the absence of workers was registered at work, what documents must be drawn up also depends.

If you have been issued leave without pay. If the FLP resumes activity before the end of quarantine, you need to understand how to properly arrange the exit of employees to work. Indeed, in labor legislation, interruption of leave without saving a salary at the initiative of the employer is not provided. Recall from the annual vacation of the Labor Code provides, but from “quarantine” - no, because this type of vacation has appeared recently. What should entrepreneurs do in this case?

First of all, you need to inform your employees that the object (store, salon, etc.) opens from a certain date, and ask if they want to go to work (a forced call is not possible). We believe that this can be done in a convenient way (by phone, email, etc.). At the same time, it is not necessary to draw up any personnel documents fixing the fact of negotiations between the employer and each employee. Confirmation that the employee is familiar with the fact that the object is being opened will be the signature of the employee recorded in the order to resume work. All employees must sign it, and not just those who go to work (if the FLP decides to gradually resume its activities).

But the desire to go to work ahead of schedule before the end of the "quarantine" vacation must be fixed separately for each. Therefore, the workers whom you plan to bring to work should write you a request to interrupt your vacation without saving your salary. After receiving applications from employees, the entrepreneur must issue an order. It is better to apply separately for each employee. But it is not a violation and one at all.

In contrast to the procedure for resuming work for employees who were granted leave without pay, it is enough for an entrepreneur to notify employees that he plans to resume work from a certain date, and also issue an order stating the position and name of those employees for which downtime is terminated and who are required to go to work from a specific date. They do not need to write any statements about stopping the downtime. Employees must familiarize themselves with the order to resume work under signature.
